TERMS AND CONDITIONS

1. Entry into this Nature’s Way promotion (Promotion) constitutes acceptance of these Terms and Conditions.

2. Information on how to enter the Promotion and prizes form part of these Terms and Conditions (Terms).

3. Entries must comply with these Terms to be valid.

Promoter and Promotional Period

4. The Promotion commences at 00:01 NZST on 01 October 2026 and closes at 23:59 NZST on 31 October 2026 (Promotional Period).

5. The Promotion is conducted by PharmaCare (New Zealand) Limited trading as Nature's Way (Promoter). Chemist Warehouse Limited (Chemist Warehouse) located at 318 Richmond Road, Grey Lynn, Auckland, 1021 is the exclusive participating retailer for this Promotion and is not responsible for the administration, operation or fulfilment of the Promotion or any prizes, except to the extent required by law.

Participating Retailer

6. The Promotion is available only at those Chemist Warehouse stores in New Zealand. Chemist Warehouse online stores, do not qualify for entry into the Promotion.

Entry Restrictions

7. Entry to the Promotion is open to New Zealand residents currently living in New Zealand, aged 18 years and over. Entrants will be required to confirm that they are aged 18 years or over as part of the Online Entry Form. Any entry submitted by a person under the age of 18 years will be disqualified.

8. Directors, management, employees, officers, and contractors (and their immediate families) of the Promoter or the Promoter’s Related Company (as that term is defined in the Companies Act 1993), or the Promoter and/or its Related Company’s retailer, supplier, or agency associated with this Promotion are ineligible to enter.

9. Online purchases from the Chemist Warehouse website (https://www.chemistwarehouse.co.nz/) are not eligible for this Promotion.

Collection of Personal Information

10. By entering the Promotion, entrants consent to the Promoter collecting, holding, using, and disclosing their personal information for the purposes of administering the Promotion, verifying eligibility, contacting and notifying winners, and fulfilling prizes. Personal information collected may be shared with Chemist Warehouse and any third-party prize fulfilment partners to the extent necessary for these purposes. The Promoter will handle all personal information in accordance with its Privacy Policy (available at www.naturesway.co.nz and the Privacy Act 2020. Entrants who wish to access or correct their personal information may contact the Promoter at competitions@pharmacarenz.co.nz

11. Person information includes any information about an identifiable individual (Personal Information). The types of Personal Information collected by the Promoter in connection with the Promotion may include the entrant’s: a. full name;

a. date of birth;

b. email address;

c. home address;

d. telephone number;

e. purchase receipt number and purchase date.

Entry Mechanism

12. To enter the Promotion, each entrant must, during the Promotional Period:

a. purchase any Nature’s Way product from a participating Chemist Warehouse store in New Zealand;

b. visit https://www.naturesway/competitions (Promotion Website) by scanning the QR code found on the till receipt, instore point-of-sale materials, or online promotional materials, or by going to the URL directly;

c. fully complete and submit the online entry form (Online Entry Form); and

d. upload an image of his/her purchase receipt.

Online Scratch Card Participation and Prize Claim Process

13. Upon submitting a valid entry pursuant to clause 13 above, eligible entrants will be granted access to one (1) online scratch card.

14. Entrants may access their online scratch card immediately upon receipt.

15. To reveal the outcome, entrants must use their mouse, finger, or other compatible input device to scratch the designated area of the online scratch card.

16. The outcome of each online scratch card is predetermined by the Promoter's secure prize allocation system and is not influenced by the entrants’ actions in any way, including the manner in which they scratch the card.

17. If an entrant’s online scratch card reveals an instant win message, he/she is a winner and will receive on-screen instructions explaining how to claim his/her prize. Prior to any prize being paid out, the Promoter will verify the winning entry and the purchase receipt directly with the winner to confirm eligibility. The Promoter reserves the right to invalidate any entry that does not comply with these Terms.

18. The Promoter will make all reasonable efforts to contact each winner using the contact details provided at the time of entry. If a winner cannot be contacted within 30 days of the date on which he/she is notified as a winner, or if a winner fails to claim their prize within 30 days of that notification date, the Promoter reserves the right (but is not obligated) to offer the prize to an alternative entrant selected in accordance with these Terms, or to retain the prize. Unclaimed prizes will be forfeited after the expiry of the 30-day claim period.

19. If the online scratch card does not reveal a winning message, the entrant will be notified immediately that their entry was unsuccessful and will be entered into a second chance draw to be drawn from unclaimed entries at the end of the promotional period.

20. Each purchase receipt number may only be used to enter the Promotion once. Attempts to enter using a receipt number that has already been submitted will be rejected by the Promotion Website.

Prizes and Winners

21. There are twenty (20) prizes available, each consisting of NZD $1,000 cash (Prize), for a total prize pool of NZD $20,000.

22. The Prize amount will be transferred to a nominated New Zealand bank account provided by the winner within 10 business days from the end of the promotional period. The nominated bank account must be in the winner's legal name. The Promoter reserves the right to verify the winner's bank account details before effecting any transfer. The Promoter accepts no liability for any misdirected or failed transfer where incorrect bank account details are provided by the winner.

General

23. Nothing in these Terms is intended to negate or modify a consumer's rights or remedies under the Consumer Guarantees Act 1993.

24. All taxes which may be payable as a consequence of receiving a Prize are the sole responsibility of the recipient.

25. The Promoter assumes no responsibility for any failure to receive an entry, any inaccurate or incomplete information provided by the entrant, or any loss, damage, or injury resulting from technical, network, telecommunications, or system failures, including security breaches, except where such loss, damage, or injury is caused by the Promoter's negligence or where liability cannot be excluded under applicable law.

26. The Promoter’s decisions regarding all aspects of this Promotion are final and no correspondence will be entered into.

27. The Promoter reserves the right to amend, suspend, or cancel the Promotion if it cannot be run as planned due to reasons beyond its control.

28. If any entrant attempts to compromise the integrity or proper operation of the Promotion by cheating, committing fraud, submitting automated or computer-generated entries, or manipulating the Promoter's prize allocation system in any way, the Promoter reserves the right to render that entrant's entry invalid and ban that entrant from participating in any current or future promotions run by the Promoter. If an individual has been disqualified under this clause 29, then that individual will be required to return or otherwise make restitution of any prize received.

29. Failure by the Promoter to enforce any of its rights under these Terms does not constitute a waiver of those rights.

30. If any of these Terms are determined to be illegal, invalid or otherwise unenforceable, then the remaining Terms and Conditions shall continue in full force and effect.

31. The Promoter accepts no responsibility for the Promotion entries that are lost, altered or damaged, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

32. The Prizes are subject to the terms and conditions located at www.naturesway/competitions and www.chemistwarehouse.co.nz/competitions/naturesway.
